The New Year, New You 2014 contest (the “Contest”) is presented and administered by The Shopping Channel, a division of Rogers Broadcasting Limited (“Contest Sponsor”). No purchase necessary.
1.ELIGIBILITY. This Contest is open to residents of Canada who are over the age of majority in their province or territory of residence, excluding employees of the Contest Sponsor, its parent and affiliated companies, representatives, dealers and agents, Contest suppliers and judges, and those with whom they are domiciled.
2.CONTEST PERIOD. The Contest period (the “Contest Period”) starts at 12:01 am on December 21, 2013 and continues until 11:59 pm on January 20, 2014. Eligible entries received by 11:59 pm on December 26, 2013 will have a greater likelihood of winning. All times are Eastern.
3.HOW TO ENTER. No purchase necessary. One (1) entry per person. The Contest may be entered either online or by mail.
To enter the Contest online, visit tsc.ca/newyou (the “Website”) during the Contest Period, and complete the Contest entry form, including a story, which must be between 150 and 200 words, describing in English or French:
What would you do if you could make a new beginning for yourself in January? Would this new beginning improve your life? And what would that improvement be?
To enter the Contest by mail, send an entry to The Shopping Channel c/o New Year, New You Contest, 59 Ambassador Drive, Mississauga, ON L5T 2P9 during the Contest Period. Entry must include i) your full name; ii) your mailing address and daytime telephone number; and iii) a story fitting the criteria listed above.
Each entry form fully completed and duly submitted, containing one (1) story submission as instructed, is referred to as an “entry”.
4.By entering the Contest, each entrant confirms that he or she: owns all intellectual property rights in the entry, including copyright in the story portion of the entry; grants the Contest Sponsor a worldwide, perpetual, royalty-free licence to reproduce and to distribute the entry, in whole or in part and in any form or format; and waives all moral rights in respect of the entry. Each entrant further releases the Contest Sponsor from any claims arising from the distribution of the entry, whether in any other form or medium now or hereafter created. The Contest Sponsor reserves the right to refuse any entry in its sole discretion.
5.Any attempt or suspected attempt to exceed the limit of entries per person, any use of robotic, automatic, programmed or any entry methods not authorized by these rules, will be deemed as tampering and will void all of your entries. All entries that are incomplete, illegible, damaged, contain profanities, contain erroneous contact or entry information or do not conform to or satisfy any condition of these rules may be disqualified by the Contest Sponsor in its sole discretion. Entries may not be submitted on behalf of any other person.
6.PRIZES. Contest entrants are eligible to win one (1) of five (5) Grand Prizes, each consisting of up to ten thousand dollars ($10,000 CDN) worth of items and/or services. Prize items and/or services to be inspired by the stories submitted by the winning entrants, and in any event to be determined in the sole and absolute discretion of Contest Sponsor. Value of each Grand Prize shall not exceed $10,000 CDN.
The following conditions apply: Prizes must be accepted as awarded and may not be transferred, redeemed, refunded or exchanged for cash absent the consent of the Contest Sponsor, which consent may be withheld in the Contest Sponsor’s absolute and sole discretion. Prizes are not replaceable in whole or in part if lost or stolen. No financial compensation will be made or required if actual Grand Prize value is lower than the total value quoted in these rules.
7.JUDGING OF ENTRIES. On each of the following judging dates, a representative from the Contest Sponsor will review eligible entries received prior to such dates, and judge those entries on the following criteria: mass appeal of story; whether the outcome of the story can be realistically achieved; and originality of story.

One (1) entrant will be selected on each judging day. Non-selected entries will carry over to the next judging date.
8.Decisions and rulings of the Contest Sponsor and/or its representative(s), including the Contest judges, are final and binding without appeal in all matters related to this Contest and the awarding of a prize.
9.ODDS OF WINNING. Odds of winning depend on the number of eligible entries received by each judging date. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by the Contest Sponsor. The Contest Sponsor takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. The Contest Sponsor is not responsible for any errors or omissions in printing or advertising this Contest. All Contest entries become the property of the Contest Sponsor and will not be returned.
10.Selected entrants will be contacted by the Contest Sponsor by phone or email. A selected entrant will be disqualified and required to forfeit any claim on the Contest prize if: he or she cannot be reached within three (3) business days following the first attempt of contact; or the terms set forth in these Contest rules are not adhered to, including without limitation those requirements set forth in the Winner Confirmation section, below.
11.WINNER CONFIRMATION. To be declared a winner, the selected entrant must: correctly answer without assistance of any kind, whether mechanical or otherwise, a time-limited, mathematical skill-testing question to be administered during a pre-arranged, mutually convenient time; be in full compliance with these Contest rules; sign and return a release of liability and publicity release and any other documentation as may be required by the Contest Sponsor in its sole discretion; and consent to participate in a production video (the “Production”) that will be filmed at the entrant’s place of residence (or another suitable location, to be determined in the sole discretion of the Contest Sponsor) at a time to be mutually agreed upon by the entrant and the Contest Sponsor, each acting reasonably. If a selected entrant does not fulfill the conditions set out in these rules, or declines or forfeits a Contest prize, the Contest Sponsor reserves the right, in its sole discretion, to cancel such Contest prize or to select another entrant. Without limiting the generality of the foregoing and for purposes of clarity, if the selected entrant declines to participate in the Production, such entrant will forfeit his or her claim to any Contest prize, and another eligible entrant will be selected in the sole discretion of the Contest Sponsor.
12.RELEASE OF LIABILITY / CONSENT TO PUBLICITY. By accepting a Contest prize, the winner: confirms compliance with the Contest rules; acknowledges that the prize is not transferable (except as provided for herein and only at the Contest Sponsor’s sole and absolute discretion) and must be accepted as awarded or otherwise except where stated; consents to the use of his/her name, city of residence, entry, voice, statements, photographs and/or other likenesses for publicity, advertising or informational purposes in any medium or format carried out by the Contest Sponsor and/or advertising agencies regarding the Contest or the prize, without further notice or compensation; and releases the Contest Sponsor, its affiliates, advertising and promotional agencies, suppliers of materials or services related to the Contest and all of their respective shareholders, directors, officers, employees and agents (collectively the “Releasees”) from and against all liability in connection with the Contest and/or the awarding and/or use of any Contest prize, including, as set out below in the LIMITATION OF LIABILITY section.
13.LIMITATION OF LIABILITY. The Releasees do not assume any responsibility and each entrant releases the Releasees from any and all claims, actions, damages, demands and liabilities of whatever nature or kind arising out of or in connection with the entrant's participation or attempted participation in the Contest and any Contest prize, including, without limitation the administration of the Contest, the selection and confirmation of any Contest winners, and the arranging, awarding and use of any Contest prize.
a)LAWS AND RULES. This Contest will be run in accordance with these Contest rules, which shall be subject to amendment by the Contest Sponsor without notice or liability to you, subject to the authorization of the Régie des alcools, des courses et des jeux du Québec (the “Régie”). Entrants must comply with these Contest rules and will be deemed to have received and understood these rules by participating in this Contest. The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein. This Contest is subject to all applicable federal, provincial and municipal laws and regulations.
b)Subject to the authorization of the Régie, the Contest Sponsor reserves the right to cancel, modify, or suspend this Contest or to amend the Contest rules at any time and in any way, without prior notice, for any reason whatsoever. Without limiting the foregoing, if for any reason the Contest is not capable of running as originally planned, for example as a result of tampering or infection by computer virus, bug, corruption, security breach, or other cause beyond the Contest Sponsor’s reasonable control, the Contest Sponsor reserves the right to cancel or suspend the Contest and/or conduct a random draw from all previously received eligible entries.
c)PRIZES PROVIDED “AS IS”. Except as expressly warranted herein, the Contest prizes are provided “as is” without further warranty of any kind.
d)UNSPORTSMANLIKE CONDUCT. The Contest Sponsor reserves the right, in its sole and absolute discretion, to disqualify without notice any entrant that it finds to be: violating the Contest rules; tampering or attempting to tamper with the entry process or the operation of the Contest or the Contest website; acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; or attempting to undermine the legitimate operation of the Contest. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS. SHOULD ANY SUCH ATTEMPT BE MADE, THE CONTEST SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION, AND TO BAN OR DISQUALIFY AN ENTRANT FROM THIS AND FUTURE CONTESTS.
e)DISPUTE REGARDING IDENTITY OF ENTRANT: If a dispute arises regarding who submitted an online entry, the entry will be deemed to have been submitted by the authorized account holder of the email address provided at the time of entry, provided the name of the authorized account holder corresponds with the full name on the entry form. The individual assigned to the email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address is considered the authorized account holder. A selected entrant may be required to provide proof that he or she is the authorized account holder of the email address associated with the selected entry. All entries must be submitted from a valid email account. If the name of the authorized account holder does not accord with the full name on the entry form, the entry may be disqualified at the Contest Sponsor’s sole and absolute discretion.
f)RESIDENTS IN QUEBEC: Any litigation in Quebec respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
g)In the event of any discrepancies between the English and French versions of these rules, the English version of these rules shall prevail.
